SmoothSail Guarantee Terms & Conditions

Introduction

  • Welcome to McCray Coastal Realty, LLC's SmoothSail Guarantee. This guarantee aims to provide our clients with a seamless and efficient real estate transaction process powered by our unique Agile/LEAN transaction management approach.


Eligibility Criteria

  • The SmoothSail Guarantee is open to clients who buy or sell residential real estate through McCray Coastal Realty, LLC.
  • To be eligible for this guarantee, clients must sign an exclusive agreement to either list or buy with McCray Coastal Realty, LLC.


What Is Covered

  • For Buyers:  If McCray Coastal Realty, LLC cannot secure a property for you at a price at least 2% below the asking price or if we are unable to negotiate for the equivalent of 2% towards your closing costs with lenders or sellers, we will cover the MCR Broker Transaction Fee at closing. 
  • Buyer Stipulation: If the listing agent has reduced the listing price within the representation period between the buyer and McCray Coastal Realty, LLC, the original listing price will be used as the reference point for these terms. For the purposes of this agreement, such reduced prices are considered in compliance with this guarantee. Price reductions can often result from our feedback to listing agents or are a part of our offer strategy; therefore, such listings remain compliant with this agreement.
  • Example:  Let's say you're looking to purchase a property with a listed price of $300,000. According to our guarantee, we would aim to negotiate the price down to at least $294,000 (2% below the asking price). Additionally, we would work with lenders or sellers to secure at least $6,000 (2% of $300,000) towards your closing costs.  If, for any reason, we are unable to meet at least one of these targets and secure the property at the specified price or obtain the necessary contribution towards your closing costs, McCray Coastal Realty, LLC will cover the MCR Broker Transaction Fee at closing.


  • For Sellers: If we fail to secure an offer contract backed by proof of funds that matches at least 90% of your listing price as per the exclusive broker listing agreement within the contract period, McCray Coastal Realty, LLC will cover the MCR Broker Transaction Fee at closing.
  • Seller Stipulation: Sellers are not obligated to accept any offer presented. Compliance with the SmoothSail Guarantee is maintained as long as an offer that falls within the stipulated range is secured and presented to the seller during the contract period.
  • Example:  A seller lists their property for $500,000 with McCray Coastal Realty, LLC, under an exclusive broker listing agreement. The contract period is set for 90 days. During this time, McCray Coastal Realty works diligently to market the property and secure potential buyers. They receive an offer backed by proof of funds for $450,000, which is 90% of the listing price as per the agreement. However, even though McCray Coastal Realty presented an offer that met the 90% threshold to the seller, the seller decided not to accept it and held out for a higher price. Despite their efforts, McCray Coastal Realty is unable to secure another offer that meets the 90% threshold before the contract period expires. In this scenario, since McCray Coastal Realty complied with the SmoothSail Guarantee by presenting an offer that meets the stipulated range (90% of the listing price) to the seller, they would not be obligated to cover the MCR Broker Transaction Fee at closing.

 


What Is Not Covered

  • Events beyond our control, such as acts of God, natural disasters, or market disruptions.
  • Delays or transaction failures can result from third-party actions, such as loan denials from financial institutions or legal issues concerning the property.


Process for Claiming Guarantee

  1. Clients must notify McCray Coastal Realty, LLC, in writing, of their intention to claim the SmoothSail Guarantee.
  2. Our team will review the claim to ensure it complies with the terms outlined here and decide on its validity.


Limitation of Liability

  • McCray Coastal Realty, LLC's liability under the SmoothSail Guarantee is limited to the waiving of the broker transaction fee as specified. It does not extend to any other financial or non-financial damages.


Amendments

  • We reserve the right to update these terms and conditions at any time. Any amendments will be posted on our official website.


Governing Law

  • The laws of the State of Florida govern this guarantee.
